Can You Seek Compensation for Losses From an Auto Accident?

An individual who has been injured or a family who has lost a close relative in a car wreck due to someone else’s carelessness or negligence, survivors may be eligible to file a claim for damages against the at-fault party. A skilled California accident attorney will work to get answers as to why this traumatic incident occurred and will seek justice and full compensation from the negligent party or entity. There are some situations where claimants may have to fall back on their uninsured and underinsured motorist protection if the negligent party has no insurance or insufficient coverage to pay damages incurred.

Depending on the facts and circumstances of the matter, an individual or entity may be considered negligent in a fatal accident case if they operated a vehicle while exceeding the posted speed limit, under the influence of drugs or alcohol, drowsy, distracted, or another form of careless driving. These are only a few examples that demonstrate negligent behavior that may warrant a personal injury claim or a wrongful death action if an individual is injured or a loved one is killed in a collision. A lawyer will gather evidence demonstrating negligence and prove that the other side failed in their duty of care.
