Motor Vehicle vs. Bicycle Collisions
Proving liability in a motor vehicle vs. bicycle crash is very much the same as proving liability in a auto vs. auto accident. Many of the same rules apply. Remember, while riding your bicycle you are subject to the same road rules and regulations as motorists driving cars, in addition to some bicycle specific laws.
If you don’t obey the rules of the road you may find yourself at fault for the traffic accident. Determining liability (figuring out who is at fault in an accident) is a question of fact. It is a process of determining who did what, and when. Many times one side is found totally at fault. Sometimes fault is split. To prove your bicycle vs. car crash case, it is best to hire an experienced bicycle injury attorney right away to protect your rights. This way, a proper investigation can begin at once and crucial evidence may be properly preserved.
