Amazon Delivery Car Involved in Castro Valley Bicycle Injury Crash

In Castro Valley,  a bicycle injury crash involving an Amazon delivery driver has left residents demanding justice. The incident occurred when a 14-year-old boy was struck by a driver, who then fled the scene, igniting public outcry. Surveillance footage captured the troubling moment when the driver, delivering Amazon Fresh groceries, backed his Toyota RAV4 into the young bicyclist.

The driver left without stopping to check on the injured teenager, who was on his way to Castro Valley High School. The collision left the boy with minor injuries and a broken front wheel, as witnessed by the school principal. Having seen the event via a Ring camera, a resident attempted unsuccessfully to halt the driver.

Investigation Underway in a Castro Valley Bicycle Injury Crash

Though the California Highway Patrol (CHP) has filed a report, efforts to identify the driver are hindered by the absence of a front license plate and Amazon’s reluctance to release information without a subpoena. The CHP is optimistic about obtaining the necessary details from Amazon, stating that cooperation between parties should expedite the investigation. The company expressed disappointment in the incident, said it did not align with their expectations of third-party contract drivers, and they would cooperate with the investigation. The CHP traffic crash unit is investigating the accident.

California Hit-and-Run Laws

In California, hit-and-run incidents are taken very seriously and classified based on the accident’s severity. The law distinguishes between hit-and-run offenses involving only property damage and those causing injury or death to individuals. Under California Vehicle Code Section 20002, failing to stop and exchange information after hitting another vehicle or property is a misdemeanor, potentially resulting in fines, probation, and up to six months in county jail.

More severe is Vehicle Code Section 20001, which addresses hit-and-runs resulting in bodily harm, such as a bicycle injury crash. This felony offense can lead to substantial fines, extended imprisonment, and a permanent criminal record. The law mandates that drivers involved in collisions must stop, assist injured parties, and exchange relevant information, reflecting the state’s commitment to accountability and public safety. For bicyclist injuries caused by hit-and-run accidents, California provides legal avenues to seek compensation and justice.

Liability in an Injury Accident Involving a Driver for Amazon

Liability in an injury accident involving a driver for Amazon follows several legal pathways. Determining liability can be complex as the incident involves a contracted delivery driver. Typically, Amazon holds contracts with third-party delivery services rather than directly employing drivers.

Identifying whether the third-party company, driver, or Amazon bears responsibility requires examining the terms of the contractual agreement between Amazon and the delivery service. Those who suffer injuries in a collision caused by an Amazon delivery person may pursue legal action against the driver personally for negligence, which involves proving that the driver owed a duty of care, breached that duty, and caused damages as a result. If it is established that Amazon failed to exercise reasonable care in hiring competent drivers or adequately monitoring delivery operations, an argument for Amazon’s indirect liability may be made.
