Officials reported that an 11-year-old Tuolumne girl has succumbed to her injuries from a catastrophic rear-end crash that occurred approximately three weeks ago in Fresno. According to a report by the Fresno County Coroner’s Office, the young child was treated at Community Regional Medical Center in Fresno on April 1st, where she passed away on April 19th. The young girl’s relatives who were involved in the same car accident were also treated at CRMC.
Details on the Catastrophic Rear-End Crash in Fresno
A preliminary report by the California Highway Patrol (CHP) revealed that a driver of a Dodge pickup truck reportedly failed to stop in time for rush hour traffic on southbound SR-99 near Clinton Avenue. The Dodge allegedly sideswiped two cars before rear-ending a Toyota Corolla carrying a family of five from Tuolumne.
The five family members, including three children and two adults, were all transported to Community Regional Medical Center in Fresno for immediate treatment. It is unclear whether the Dodge driver will be facing charges in connection with the fatal car accident as an investigation is ongoing by CHP traffic officers.
Losing Someone You Love in an Accident
Most people drive cars from point A to point B every day and often forget how dangerous riding in one can be. Even one equipped with all the newest safety features will be no match for a catastrophic crash that may lead to serious injury or even death. When a loss of life occurs in a motor vehicle collision caused by a negligent driver, the family of the decedent may have grounds to bring a wrongful death claim forward. The purpose of this type of case is to compensate survivors for the emotional and financial hardship they have experienced in connection with their loss and the fatal incident. This may include funeral service costs, loss of companionship, mental anguish, and loss of future financial support. Surviving family members may also seek costs of treatment incurred for final injuries before the decedent passed away. This may be recovered through a survival action.
Like other states, there are strict time limits for wrongful death claims in California. There is a two-year statute of limitations that generally applies, as outlined in the California Code of Civil Procedure Section 335.1. This means that a lawsuit must be filed in civil court no later than the 2nd year anniversary of the fatal car accident if a settlement is not accepted by the insurance company within that period. While this may seem like sufficient time, remember that there is significant time and effort that is involved in building these cases. Conversely, evidence proving the other side’s negligence must be gathered and preserved immediately before it is lost or destroyed.
