Chico Pedestrian Hit
I’m Ed Smith, a Chico car accident lawyer. On Friday, January 27, 2017, emergency personnel were dispatched to Hazel Street in Chico to assist with a vehicle vs. pedestrian accident.
What Happened?
Shortly after 9:15 p.m. an unidentified pedestrian was struck and severely injured by a vehicle near West Second Street and Hazel Street in Chico. When first responders arrived on scene they discovered a man in the westbound lanes of West Second Street. The driver who hit the pedestrian remained at the scene of the collision and was questioned by law enforcement officers. No information as to cause of the crash has been released.
Were There Injuries?
The man who was hit by the vehicle was found unresponsive and was rushed to Enloe Medical Center in Chico by ambulance for treatment and evaluation of traumatic injuries he suffered in the accident. The driver who struck the pedestrian did not request medical attention at the scene.

Every driver of a motor vehicle has a duty to pedestrians to pay attention to the roadway and keep a proper lookout. Everyone has a duty of care they should follow, but California courts have recognized that the danger posed by a vehicle is much greater than the danger posed by a pedestrian; the courts, therefore, require a greater duty of care by a driver. Any driver must yield their right of way to a pedestrian in a crosswalk (California Vehicle Code 19150). Even if the pedestrian is outside of the crosswalk, the driver has a duty of care to be on the look out for them. If a driver stops their vehicle to allow a pedestrian to cross in front of them, no other vehicle can pass and overtake the stopped vehicle (California Vehicle Code 21951).
