Child Hospitalized After Fresno Rollover Accident

A child was hospitalized and in critical condition after a rollover accident in Fresno, CA, on the afternoon of May 25, 2020. The car accident occurred shortly before 5:00 p.m. on Highway 168 and Gooseberry Lane. The California Highway Patrol (CHP) said a 25-year-old man reportedly lost control of his vehicle on State Route 168, veered off the roadway, and overturned on the shoulder. A 4-year-old boy suffered serious injuries in the crash and was transported via air ambulance to Valley Children’s Hospital for treatment. Additional information about the rollover was not immediately available.

Roof Crush Resistance in a Fresno Rollover Accident

In rollover accidents, one of the most significant risks of injury to vehicle occupants is insufficient roof crush resistance. The roof structures of some vehicles often do not meet Federal Motor Vehicle Safety Standard 216 on roof crush resistance. This safety regulation requires that all automakers design and manufacture roofs that can withstand at least 1.5 times the unloaded weight of the vehicle. However, some roofs fail to meet this standard and are poorly reinforced. When this happens, it may collapse inward in a rollover and crush the occupants where they sit; potentially exacerbating any injuries they have suffered. In such situations, an auto products liability claim may be filed against a vehicle manufacturer for losses incurred. A case may be brought, so long as the vehicle in question has been kept and preserved for an experienced Fresno personal injury lawyer to examine and determine whether a defect contributed to the rollover and resulting injuries. What Types of Personal Injury Damages Can I Recover?

Due to the severity of roof crush injuries involved in a personal injury case, the compensation for economic and noneconomic damages may be high. While each case is different, the types of damages that may be sought may include the following:

  • Costs of past medical expenses related to the rollover
  • Emotional anguish caused by the traumatic car accident and resulting injuries
  • Future estimated costs of medical care related to permanent injury or disability
  • Lost wages
  • Loss of future earning potential
  • Pain and suffering
