Child Killed in Winters Crash
I’m Ed Smith, a Sacramento Wrongful Death Lawyer. No parent should ever have to bury their child. When a minor dies in an auto accident, this is often a death that could have been prevented. Tragedies, such as these, strike all too often and a recent one occurred just west of Winters with a child killed by a car accident.
The Vehicle was Out of Control
A 1998 Honda Accord was traveling east on Russel Boulevard leaving Winters along County Road 93A, according to a local California Highway Patrol Officer. For reasons that are still under investigation, the driver’s vehicle flew out of control. The car collided with a light pole after rolling over. The child, a three-year-old boy, was ejected from the vehicle, suffering numerous traumatic injuries. A person who has been thrown from a vehicle is prone to suffering a variety of bone fractures that could include head and brain injuries. The child was transported to the local University of California-Davis Medical Center; however, despite medical attention, he later passed away.
The Accident is Still Under Investigation
The adults in the car were also transported to a local hospital in Vacaville for the attention of other injuries, why the child was ejected from the vehicle is still a question that is under investigation by the local California authorities. All similarly aged children should be restrained in a child safety seat because the adult seatbelt does not provide adequate protection for smaller passengers. Whether or not this child was in a child safety seat is still a question that needs to be answered. The authorities do not believe that drunk driving or drugs played a role in this tragedy.
Why Did the Vehicle Rollover?
Another question in this accident is why the vehicle rolled over. Despite the age of the vehicle, no car should ever roll over randomly. While reckless driving could have been involved, drivers who take curves at reasonable speeds in safe weather should not have to worry about their vehicle rolling over. If there was a defect in the vehicle that impacted its ability to grip curves while traveling at low speeds, this deserves to be investigated as well. Defects in various vehicle models in the past have led to wrongful deaths and that question deserves to be answered in every accident involving a rollover.
