Reasons Outside Driver Error That Can Cause an Off-Road Accident
There are several reasons a vehicle can exit the roadway that doesn’t point toward driver error. Some of these reasons include:
- Poor road conditions are a significant factor that can contribute to a major injury crash in Collierville. Potholes, loose gravel, and uneven surfaces can reduce a vehicle’s traction and unexpectedly alter its path. The government entity charged with maintenance can be held liable in these cases. However, because the statute of limitations is only six months, getting help from an accident attorney may be advised.
- Adverse weather conditions, such as heavy rain, snow, or fog, can significantly impair visibility and road grip, increasing the likelihood of accidents.
- Mechanical failures also play a crucial role; issues such as brake malfunctions or tire blowouts can suddenly cause a loss of vehicle control. In these cases, the manufacturer and others can be liable by filing an auto product liability claim.
- Wildlife or livestock on the road can lead to sudden evasive maneuvers, contributing to accidents.
- Aggressive or hit-and-run drivers can force a vehicle off the roadway and then flee the scene.
Compensation Recovery in an Injury Accident
When involved in an injury accident, it is crucial to understand the various types of compensation that may be recoverable. Economic damages are quantifiable expenses such as wage loss and medical bills. These are calculated based on actual financial losses incurred by the victim.
On the other hand, non-economic compensation includes physical pain and suffering, as well as psychological and emotional distress. These damages account for the psychological and emotional impact of the injury.
