A preliminary report by authorities revealed that a single-vehicle crash occurred around 6:30 p.m. Upon the arrival of CHP traffic officers, a vehicle was located off the roadway. Officials said the car veered out of control, went off the road, and crashed into a tree.
Sadly, the driver of the vehicle, an 18-year-old Concord man, was declared deceased at the scene.

A GoFundMe page has been established to help his family cover final resting expenses. No other details about the fatal car accident were immediately provided by police due to ongoing investigation.

What Does the Wrongful Death Claims Process Involve?

Everyone understands the pain and grief that may accompany the loss of a close relative in an unexpected accident. When the loss was the result of someone else’s recklessness or negligence, the grieving process for surviving family members may be compounded with frustration and anger. When faced with such a situation, survivors may have the grounds to bring a wrongful death claim against the party responsible for the fatal motor vehicle collision. The California Code of Civil Procedure Section 377.60 defines beneficiaries of wrongful death recovery, including the spouse, domestic partner, and children of the decedent. In some cases where these relatives are non-existent, other family members may be eligible for filing so long as it can be established that they were dependent upon the deceased.

The types of damages that may be claimed in a wrongful death action in California vary and are generally determined on a case-by-case basis. The economic and non-economic damages sought by surviving family members may generally include medical and funeral costs, loss of future financial support and services, lost companionship and care, and mental anguish. Such cases are subject to a two-year statute of limitations, as outlined in the California Code of Civil Procedure Section 335.1. This means that the family must file the case in civil court no later than two years after the fatal accident date if an insurance settlement is not accepted within that period.

Keep in mind that the process of seeking financial compensation in a wrongful death claim involves proving negligence. In the case of a single-vehicle accident, liability may lie with more than one party. For instance, a public agency may be held liable for a road defect that contributed to a fatal car accident. Conversely, an automaker may also be deemed negligent for faulty vehicle parts and equipment that played a role in a traffic collision. In either of these scenarios, substantial evidence must be gathered and preserved immediately following the incident, and an experienced accident attorney can help with that in addition to handling all aspects of the case.
