Types of Injuries Suffered by Cyclists in Traffic Accidents
A cyclist may suffer many types of injuries after being hit by a car. These include crush injuries, amputations, internal trauma, femur fractures, traumatic brain injuries and spinal cord damage. If a cyclist who was struck by a vehicle survives, they may find it challenging to enjoy the things that they once loved or work again. California law recognizes this and provides a way for people injured in bicycle accidents caused by negligence to seek justice and compensation through a personal injury claim. These types of cases are generally filed with the at-fault party’s insurance company for financial recovery of injuries and losses incurred.
What Can be Recovered in a Personal Injury Accident Claim?
When a bicycle accident changes your life, you deserve to be compensated for the financial hardship and intangible harms you have suffered and will expect to suffer in the future. A personal injury attorney in Brentwood can help you build a strong case for compensation that proves that your crash would have not happened if not for the negligent actions of the driver involved. An attorney will work diligently to prove the full and fair value of your personal injury case and negotiate a settlement with the other driver’s insurance company to fully compensate you for your:
- Past and future medical expenses for treatment of injuries related to a bike crash
- Loss of quality of life as a result of a traumatic cycling collision
- Lost income and future earning capacity due to being unable to work temporarily or permanently due to an accident injury
- Pain and suffering for the emotional suffering and physical pain a bicycle accident-related injury has caused
- Punitive damages may be recovered only from the negligent driver as a way of punishing them for their wrongdoing and to deter similar behavior in the future (e.g., DUI or excessive speeding)

What if the Other Driver Does Not Have Insurance for a Brentwood Bicycle Accident?
In personal injury cases where the at-fault party does not have insurance, an injured cyclist may use the uninsured motorist coverage of their insurance policy to fully cover damages incurred. If the other driver had insurance but not enough bodily injury liability coverage to pay for injuries and losses resulting from a bicycle accident, an injured party may seek recourse through their underinsured motorist coverage. If the bicyclist did not have insurance but lived with a relative who does, their uninsured/underinsured motorist coverage may be extended in such situations, so long as they are not excluded from the auto insurance plan.
