Things to Know About Bicycle Accident Injury Cases

Bicycles provide cyclists an alternate mode of transportation with endless health benefits and adventures. The unfortunate reality is that riding a bicycle may come at a cost as cyclists have little to no protection in a traffic accident. If you have suffered traumatic injuries in a bicycle accident caused by a negligent driver or entity, you may be able to seek financial compensation for your medical bills, lost income, pain and suffering, and other losses. However, such cases may be challenging as there may be a wide array of factors involved in the personal injury claims process. All of which may impact the value of the case.

Drivers are required to carry liability coverage for property damage and bodily injury in California. However, the state minimum limits may not be sufficient to cover injuries and damages in a motor vehicle accident, particularly one involving a cyclist. This is especially true when serious injuries are involved. When a motorist causes a bicycle accident and has little to no insurance coverage, there may be recourse available for an injured cyclist if they have an auto insurance policy and carry uninsured/underinsured motorist protection. This type of coverage will cover damages up to the limits of the policy. It may also extend to other members of a household. This is a potential option for recovery so long as the cyclist was not excluded from that household member’s policy.

Whether it is a first-party or third-party insurance claim, it is not uncommon for insurers to make lowball settlement offers for claims or outright deny them. After all, insurance companies are businesses focused on protecting their bottom line. Keep in mind that even if the insurance adjuster seems friendly and concerned about your situation, they may be looking for reasons to devalue or dispute your claim. These are some of the many defense tactics insurance carriers may use in the claims process. For more information on the various factors involved, watch this video.
