Driver Experiences Off-Road Accident on S.R. 20
An off-road accident close to Nevada City resulted in major injuries to the driver when their vehicle crashed off the side of the mountain on May 12. The accident happened along State Route 20 just north of Zeibright Road around 2:30 p.m. The person who reported the accident to the California Highway Patrol (CHP) said he could not see the car and where it went off but walked down the roadway.
Driver Suffers Serious Injuries in Off-Road Accident
The vehicle had crashed off the side of the mountain and gone down the embankment about 300 feet. Cal Fire first responders determined the driver had suffered head and neck injuries. The highway was shut down for vehicle recovery, and one-way traffic control was placed. The injured party was transported by helicopter to a hospital. CHP traffic investigators are working to determine what happened to cause the accident.
Off-Road Collision Causes
In addition to driver error, there are many factors that can lead to off-road collisions. When negligence by another motorist or entity causes another driver’s vehicle to leave the roadway and be injured, they may be able to file a personal injury claim to recover damages. Below is a list of some of the common causes of off-road accidents:
- Defective auto parts: Faulty vehicle parts can lead to a breakdown and cause an accident. The vehicle can be examined for defects if it is retained. If a defective auto part caused the collision, a product liability claim may be filed against the company that made the part, the manufacturer and others.
- Poorly maintained roads: Poorly maintained roads, such as those with potholes or loose gravel, can contribute to off-road crashes by causing drivers to lose control of their vehicles. In addition, some roads are designed poorly, leading to hazardous driving conditions. The government entity responsible for roadway maintenance and design can be liable for injuries. However, the time limit to file is only six months, so getting legal help may be advisable.
- Aggressive drivers or road rage: Drivers who drive aggressively or engage in road rage can cause serious off-road accidents.
Compensation Recovery and How a Lawyer Helps
A lawyer can help those injured in accidents caused by another’s negligence to seek the compensation they deserve. Often, a lawyer can negotiate with an insurance company to ensure the injured party receives a fair settlement. A lawyer will also be able to guide them through the process of filing a lawsuit if necessary, and they may be able to provide legal advice to ensure they receive the compensation they deserve.
Additionally, a lawyer can help with other aspects of the case, such as collecting evidence, interviewing witnesses, filing paperwork and more. A lawyer can provide personalized advice and guidance as well as support throughout the entire process. A personal injury lawsuit can be stressful and overwhelming, but having a lawyer on your side to handle all the details can provide peace of mind for victims as they seek justice for their injuries.
