Driver Killed After Fatal Car Accident in Modesto
A driver was fatally injured and another was critically injured after a fatal car accident on Standiford Avenue in the Modesto area on the night of Friday, October 23, 2020. The fatal crash occurred at the intersection of Carver Road and Standiford Avenue at approximately 9:15 p.m. A red Jeep Wrangler reportedly pulled out of a parking lot onto the north side of Standiford Avenue and attempted to make a left-hand turn into the eastbound lanes. While doing so, her Jeep was reportedly broadsided by an Infiniti coupe headed westbound, the Modesto Police Department (Modesto PD) reported.
The Jeep driver, 49-year-old Robin Stephens of Modesto, was allegedly ejected from her vehicle and transported by ambulance to a local hospital for treatment. Sadly, she succumbed to her injuries during hospitalization. The driver of the Infiniti was hospitalized for serious injuries and is expected to survive. The woman riding with the driver in the Infiniti sustained injuries described as minor in the crash.
Losing a Family Member in a Fatal Car Accident
The loss of a close relative is painful, particularly if someone else is to blame for the unexpected death. When a loved one is killed in a car accident in California, liability will be essential for a wrongful death claim for justice and compensation. California is an at-fault negligence state, meaning that it must be proven that the other party was responsible for the fatal crash before the surviving family members can recover wrongful death damages from the insurance company. Unfortunately, settlements from insurers may not be fair, despite providing compelling evidence and proving negligence on behalf of their insured. If a wrongful death settlement offer is too low, families should keep in mind that they are not obligated to accept it. Instead, survivors can speak with an experienced car accident attorney in Modesto about their legal options for a full and fair recovery.
Types of Wrongful Death Compensation
Surviving family members may be entitled to the following economic and non-economic damages through a wrongful death action:
- Costs of medical treatment for the decedent’s injuries before their death
- Expenses related to funeral and burial services for a lost loved one
- Loss of inheritance, benefits, and future earnings for the family
- Lost companionship, protection, and care
- Mental anguish for survivors
Surviving family members may also seek punitive damages in wrongful death cases where the negligent party acted egregiously. These damages are not intended to compensate survivors. They solely serve the purpose of punishing those responsible for the wrongful death in hopes of preventing similar conduct from them and others in the future.
