Accident Near Lincoln Casino Caused Diesel Spill

A driver was arrested for suspected drunk driving following an accident that happened in the vicinity of the Thunder Valley Casino Resort near Lincoln on July 21. The Auburn Division of the California Highway Patrol (CHP) said that the accident occurred at about 6:30 in the morning when a pickup struck a gravel truck broadside that was moving west along Athens Avenue. The impact of the collision caused damage to the gravel truck’s gas tank, and about 80 gallons of diesel fuel spilled onto the roadway.

Athens Avenue Closed Due to Accident and Diesel Spill

Hazmat crews had to be called to the scene to perform cleanup, resulting in the closure of Athens Avenue westbound. No injuries were reported as a result of the accident. The incident is under investigation to determine how the collision occurred.

Dangers of Drunk Driving

Drunk driving is responsible for more than 1 million arrests each year by law enforcement. The horrifying news is that more than 10,000 people died in traffic collisions in 2019 because of a drunk driver, and someone is injured every two seconds. In California, a driver with a BAC level of 0.08 is a drunk driver. The way that alcohol affects someone behind the wheel of a vehicle includes:

  • Balance is adversely affected
  • A loss of coordination occurs
  • Speech, hearing and vision are affected
  • Judgment is lessened
  • It’s more difficult for the drunk driver to detect danger
  • Memory is impaired as well as the ability to reason
  • There is a reduced ability to process information
  • Perception is impaired
  • It becomes more difficult for the driver to concentrate
  • The driver has more trouble controlling the speed of the vehicle

Filing a Claim for Compensation Following a Drunk Driving Accident

When someone is injured by a drunk driver in an accident, they may be able to claim compensation. This can cover the cost of all of their medical expenses, lost wages due to the inability to work and for their pain and suffering. Over the years, my team of injury attorneys and I have been successful in handling many cases involving accidents where a drunk driver was the cause.

Gathering Evidence to Support a Claim for Compensation

Gathering evidence following a collision injury caused by drunk driving is important to prove an injured party’s claim for compensation. Remember, most injury lawyers work on a contingency basis. This means that an injured person owes nothing until the case is won. Some of the areas of investigation include:

  • Our investigative team checks the background of the driver who caused the accident. Those who are drunk driving and cause a collision often have a past record of being inebriated behind the wheel of a car.
  • The traffic accident report by the responding police is checked for inaccuracies.
  • Accident reconstruction is carried out because it can show how the crash occurred and point toward which driver was at fault.
  • Witnesses of the drunk driving accident are interviewed. In some cases, a witness taped the accident on their cell phone as it happened.
  • Business and traffic surveillance cameras are checked to see if the accident was captured.

Our injury attorneys can construct a case that strongly supports our client’s claim for compensation by compiling all the evidence.
