Rider Killed on West Harris Street in Electric Scooter Crash

On September 27, an electric scooter crash resulted in the death of a rider along West Harris Street near the Eureka Mall. The accident occurred around 8:00 a.m. near the intersection with Elizabeth Street. Responders from the Humboldt Bay Fire Department found the rider unresponsive upon arrival, and despite their efforts, the individual was pronounced dead at the scene. The section of road from Spring to Albee Streets was closed until about 10:30 a.m. for the investigation.

Electric Scooter Crash Rider Hit by Two Vehicles

A forensic analyst and the Traffic Investigations Team of the Eureka Police Department took charge of the investigation. It was reported that the scooter rider was crossing West Harris Street outside a designated crosswalk when an eastbound vehicle struck him. A second vehicle turning from Prospect Avenue onto West Harris struck the rider moments later, with police noting that the rising sun impaired visibility.

Investigation by Local Authorities in Electric Scooter Crash

Both drivers and witnesses remained at the scene, cooperating fully with authorities, who confirmed that alcohol, drugs, and excessive speed were not factors in the incident. The investigation is still active, and anyone with further information is encouraged to contact Field Training Officer Mark Sheldon at (707) 441-4300.

Who Can File a Claim for a Wrongful Death?

Family members most closely related to the deceased have the right to initiate a wrongful death lawsuit. This typically includes the spouse and children if they depended on the deceased for at least half their financial support. The estate’s administrator is also eligible to file such a claim. Since only one claim is permissible, family members must agree on who will file it. Without a spouse or children, the deceased’s parents and siblings are entitled to pursue a claim.

Compensation for Accidental Death

When a loved one loses their life in an electric scooter crash, no amount of financial compensation can truly substitute for the loss. However, they would not want to leave their family under financial strain. Individuals who pursue wrongful death lawsuits may be entitled to the following damages:

  • Funeral and burial expenses can be recovered.
  • Families can claim compensation for the loss of emotional support and affection provided by the deceased.
  • Income and benefits the deceased would have contributed, including insurance and retirement, may be recouped until the estimated retirement age.
  • The costs for services the deceased person routinely provided at home may be recovered.
  • In some instances, it is possible to recover inheritance loss.
