Recovery of Compensation in a Pedestrian Accident
Pedestrians are susceptible to severe injuries when hit by motor vehicles, resulting in lengthy hospitalizations and lost wages. In this situation, the pedestrian is eligible to seek compensation against the at-fault driver. Compensation can be recovered in the following areas:
- Medical costs: Injury to a pedestrian can result in medical expenses that can be recovered. This includes everything from the ambulance to hospitalization, physicians’ fees, prescriptions and surgeries to rehabilitative care. Should the injury persist, future expenses are also covered and can be calculated by your lawyer.
- Lost wages: Lost wages can be recovered if the result of the pedestrian injury accident prevents him/her from working. The recovery of lost wages includes any pension/insurance coverage, bonuses and other perks the worker received.
- Pain and suffering: Compensation for the pain and suffering caused by your physical injuries is recoverable. Professional treatment may be required if emotional or psychological compensation is needed, such as when you’ve been diagnosed with post-traumatic stress disorder.
Pedestrian Accident Investigation
It is important to collect evidence to support a client’s claim for compensation in pedestrian accidents, just like it is with other types of collisions. To collect evidence, investigators go to the accident site and perform the following:
- Police reports are examined to determine their accuracy. If errors are found, it may not be possible for the client to file a claim to recover compensation.
- Checking traffic surveillance cameras around the area, we look for whether the pedestrian injury accident was captured on video. The film may serve as strong evidence about the cause of the collision if subpoenaed.
- The area is searched for paint chips and metal fragments that may have been dropped by the vehicle. A vehicle’s make and model can be positively identified by these indicators.
- We interview any witnesses who saw the pedestrian accident as it happened. Occasionally, the accident was recorded by a witness on their smartphone.
- By performing an accident reconstruction, it reveals what happened during the collision. Such evidence is acceptable as proof in civil court cases and by insurance companies.
Putting Together a Claim Based on Evidence
