Eureka Area Accident Fatality
I’m Ed Smith, a Eureka car accident lawyer. A man who received fatal injuries in an area accident was identified by officials on January 9, 2018. The man was identified as William Gilbert of the nearby area of Woonsocket. Our sincere sympathies are extended to Gilbert’s relatives and friends.
Accident Details
The California Highway Patrol (CHP) who responded to and are investigating the accident, released an incident report that indicates that Gilbert had been driving a 1997 Chevrolet Silverado 1500 when the crash occurred on January 6, 2018.
Gilbert had been driving north on Highway 101 a short distance to the north of the intersection at Black Oak Ranch. While driving, reports indicate that Gilbert’s vehicle drifted off of the roadway and onto the right-hand shoulder. The reason that Gilbert’s vehicle drifted remains unclear to authorities.
After drifting onto the shoulder, Gilbert apparently steered his vehicle abruptly to the left before losing control. After Gilbert lost control, the Chevrolet crossed over the highway and drove off an embankment on the left-hand side of the highway. The vehicle reportedly overturned multiple times as it traveled down the embankment and finally came to a rest on its roof in the middle of a creek.
Injuries
Responding officers at the site of the accident discovered Gilbert inside of the Chevrolet. When officers arrived, Gibert had already passed away due to injuries sustained during the collision. As such, Gilbert was declared deceased at the accident scene.
The specific injuries that Gilbert sustained, as well as information about whether or not he had been wearing a seatbelt, were not included in the accident report. Additionally, no other persons or vehicles were reported to have been involved in the crash.
Investigation
At the time of reporting, CHP officers were actively investigating possible accident causes. Officers indicated that they were looking into whether drugs and/or alcohol had anything to do with the crash.
This accident may have happened because of a variety of factors. Other factors may include insufficient roadway signage, poor road conditions, driver distraction, faulty vehicle parts, and more.
Wrongful Death
When an individual dies because of another party’s negligence, it is considered an instance of wrongful death. The details of a wrongful death case can be complicated and, depending on individual circumstances, may include specific deadlines and procedures that an experienced lawyer can help you to understand and deal with.
Those able to receive compensation in cases of wrongful death can recover for a wide range of damages including things like loss of companionship, parental guidance, financial support, and more.
