Eureka Area Pedestrian Fatality

I’m Ed Smith, a Eureka personal injury lawyer. One person was killed while walking along Highway 21 near Miranda on Monday, April 23, 2018. The California Highway Patrol (CHP) said the fatal accident involved a large semi-truck and a pedestrian on the local highway. The identity of the fatally injured victim has not been confirmed. I would like to express sympathy to the loved ones of the deceased victim while they mourn this tragic loss.

Crash Details

The public information officer at Caltrans reported that the accident took place sometime between 5:00 a.m. and 6:00 a.m. One CHP officer noted that it is unclear why the pedestrian was on the highway, but that the individual had been struck by a big rig.  Responding officers reported that they found the pedestrian deceased at the accident scene.

Investigation and Response

CHP conducted preliminary investigations at the accident site immediately after responding to the crash. It remains unclear whether or not DUI is a factor and no possible causes for this accident have been reported by CHP so far. Factors being looked at by investigators include things that commonly cause accidents such as fatigued driving, vehicle part malfunctions, distracted driving, visibility, roadway hazards, and more.

Trucking Accidents

Accidents that involve large trucks often cause serious injuries and, usually, truck drivers aren’t the ones who get hurt. Because driving a big rig is so dangerous, truck drivers are held to higher standards than drivers of passenger vehicles. Commercial truck drivers and companies are required by both state and federal governments to keep close records of important information like driving hours and equipment maintenance. However, truck companies are also usually ready to defend themselves when a collision happens. Most companies will immediately have a legal team working to reduce their fault in the eyes of insurance companies and courts. Because of this, those who have been hurt or lost somebody in a trucking accident should call a lawyer as soon as possible.
