Intoxication May Have Factored in Intersection Fatal Crash on Henderson Street

A Eureka intersection fatal crash occurred between two vehicles on November 7 that may have involved an intoxicated driver. The collision was reported at the Henderson intersection with I Street around 12:10 p.m., according to Eureka Police Department officers. One of the vehicles overturned, trapping its occupants inside.

Vehicle Rollover Involved in Intersection Fatal Crash

Firefighters with the Humboldt Bay Fire Department extricated the driver, who was taken to a hospital with injuries ranging from moderate to minor. The vehicle’s passenger suffered fatal trauma in the accident. The accident report said the driver was going north along I Street, ran a red light, and their vehicle was hit by another car going west along Henderson and then overturned.

Authorities Determining Whether Intoxication Contributed to Fatal Accident

Police think intoxication may have factored in the cause of the intersection fatal crash. Eureka Police Department detectives are asking witnesses to the collision to contact them at (707) 441-4044. The deceased person in the accident was identified, and their name will be released once the next of kin has been notified by the county coroner’s office.

Who Can File a Wrongful Death Lawsuit

The immediate family of a deceased person may bring a wrongful death claim. This would include the spouse and children who received at least half of their financial support from the decedent. So can the administrator. The estate administrator has the right to file a claim, but only one is allowed, so a decision must be made about which will do it. The parents and siblings may file if the deceased had no spouse or children.

Compensatory Damages for Wrongful Death

Financial compensation cannot compensate for the loss of a loved one in an intersection fatal crash. Nevertheless, they probably wouldn’t want their family to be financially stressed. Those who file a wrongful death claim after a highway crash can often collect the following damages:

  • As a result of the decedent’s death, the family would have lost income, including benefits such as insurance and retirement coverage. This coverage is recoverable until the deceased’s retirement age.
  • Expenses associated with the funeral and burial can be recovered.
  • Recovering costs associated with services the deceased usually provided to his or her family is possible.
  • In some cases, inheritance loss can be recovered.
  • Survivors may also be compensated for lost affection and emotional support the deceased provides.
