Causes of Pedestrian Accident Injuries
Some pedestrian injuries are caused by the walker. Many are caused by a negligent driver. Some of the ways in which a driver can be at fault include:
- Distracted driving: Texting while driving has become the number one type of negligence that leads to a traffic accident.
- Speeding: A driver is expected to have a duty of care toward others to keep from harming them. A driver who is speeding may not be able to stop in time to avoid striking a pedestrian who is crossing the street.
- Drunk or drugged driving: Being intoxicated seriously affects a motorist’s ability to drive safely, and this can lead to a collision with serious injuries or fatalities.
- Fatigued driving: A motorist who is sleepy is not alert enough to be safe behind the wheel of a vehicle.
- Reckless driving: A driver who weaves in and out of traffic, runs red lights, and commits other acts of negligence is more likely to become involved in an accident involving a pedestrian.
Pedestrian Accident Investigations
Pedestrian accidents cause thousands of deaths and injuries every year around the nation. One of the main causes of a pedestrian accident is a negligent motorist. By conducting an investigation and collecting evidence, a claim for compensation by an injured pedestrian can show that the at-fault driver was the cause of their injury. Our team of investigators go to the accident site right away and use some of the following investigative techniques, among others:
- Accident reconstruction is performed, which can indicate how the crash involving the injured pedestrian occurred. Photos are taken of the scene and vehicle.
- The investigators will go over the police report to ensure that it is accurate.
- They will interview witnesses to the accident.
- The investigators check the medical report of the injured pedestrian, which can not only gather evidence for appropriate compensation but indicate what position the walker was in when struck.
- Traffic and road surveillance cameras are sought because they might have caught the accident on tape.
Our lawyers take the gathered evidence to build a case in support of our client’s claim for personal injury compensation. It can be used when negotiating with the insurance company or in court.
