Two People in Falling Tree Incident on Auburn Folsom Road
A falling tree fell on two vehicles on March 19, causing the hospitalization of two people. The accident occurred around 3:30 p.m. along Auburn Folsom Road between Douglas Boulevard and Cavitt Stallman Road. Both vehicles were SUVs.
Both SUVs Severely Damaged in Falling Tree Accident
One SUV exhibited major front-end damage. The other SUV had its windshield broken and the roof on the passenger side damaged when a tree branch landed on the vehicle, according to the California Highway Patrol (CHP). Both people who were hospitalized after the accident are said to have suffered moderate injuries.
Atmospheric River Conditions Thought to Cause Falling Tree Increase
A local resident with a tractor helped clear the roadway, and firefighters with the South Placer Fire District arrived to extricate one person from their vehicle and used chainsaws to help clear the fallen tree. High winds caused by the atmospheric river system are thought to have weakened many trees in the area, which increases their risk of falling. Traffic was blocked in both directions.
Trees Are Affected by Weather Conditions
Dry, windy or weather that brings heavy rains causes trees to become stressed and more likely to fall. There is no warning, however, and they can fall at any moment. Because trees are so heavy, they can cause enormous damage when they fall, injure people in their paths or result in fatalities.
Injury from a Falling Tree: How to Recover Compensation
Obtaining compensation begins with determining who owns or is responsible for the property on which the falling tree accident occurred. In addition to those on private property, there are trees on land controlled by businesses, cities, states and even the federal government. An injury lawyer can help you determine who is responsible for your trauma. A compensation claim begins with that step.
Once ownership of the falling tree is established and it can be shown that negligence was the cause of the accident, the at-fault party can be held financially responsible for your injuries.
Government Entities and Claims
Government entities such as cities, counties and states have much shorter statutes of limitations than most other types of personal injuries. The time limit for filing an injury claim is six months. You will not be able to bring your case to court if you miss the deadline. Considering the other deadlines involved, it may be best to hire an injury lawyer to handle your claim. By doing this, all paperwork will be filed before the deadlines. As an additional benefit, the lawyer can assist you in negotiating with the government entity for a better settlement.
