Train Accident at West Olive Avenue Intersection Kills Man on Tracks
A fatal accident occurred in Turlock on October 18 when a train struck a pedestrian. The Turlock Police Department reported that the accident happened around 2:37 a.m. along the tracks east of North First Street and West Olive Avenue when the man was struck by a northbound freight. The train stopped for around 90 minutes as an investigation was conducted by Turlock officers to determine how the fatal accident occurred. Intersections were blocked from West F Street to West Canal as a result.
Information Sought by Police on Fatal Accident
The man who died in the train accident was identified by the Stanislaus County Coroner’s Office as Frank Fink, age 41, and a Turlock resident. The news release by the police said Fink was dressed in all black when the accident occurred. It is unknown why he was on the railroad tracks. Anyone who witnessed the accident or who might have information is asked to call (209) 668-6529 and speak to Officer Cherish Hood.
Investigating a Fatal Accident With a Train
Train accidents that involve an injury or fatality are required to be reported to the Federal Railroad Administration. They send investigators who work with local police to find out how the accident happened and to find out who was at fault. An injury lawyer who has experience in handling these types of accidents works with federal and local investigators to determine what happened. In this way, the lawyer can help the injured party or grieving family obtain compensation.
Recovering Compensation Following a Fatal Accident With a Train
Our investigation team heads right to the accident site to collect the evidence needed to determine liability. Negligence can include defects at railroad crossings or on the tracks, performance by the engineer, or poor maintenance, so the braking system wasn’t working correctly. When the evidence is gathered, our injury lawyers use it to construct a strong case that supports the family’s wrongful death claim or the injured party’s personal injury. The evidence can be presented in court if necessary or used to negotiate a fair settlement with the insurance company.
Recoverable Damages in a Wrongful Death
A family that is deep in grief when a loved one dies generally doesn’t think about filing for wrongful death until they realize the income that person provided is gone and they face high funeral expenses. However, when negligence was the cause, they can not only recover that financial loss but can obtain a sense of justice for their loved ones. By filing a wrongful death lawsuit, they can recover:
- The funeral and burial expenses are recoverable.
- Loss of the loved one’s income, including pension benefits, insurance, and more up until their normal age of retirement, can be claimed.
- The surviving spouse can place a claim for loss of consortium, affection, and moral support the deceased person provided.
- Children in the family, whether natural, adopted, or others who received half of their support from the deceased can claim loss of guidance and nurture.
- Anyone else in the immediate family who receives at least half their support from the decedent, such as parents, may recover damages for the loss.
- Loss of inheritance is recoverable if the estate would have increased.
During this difficult time, an injury lawyer can take the stress off the family’s shoulders. They can grieve in peace, knowing they will not suffer added financial stress because their loved one died.
