Financial Recovery in Traffic Accident Cases
A personal injury claim is a legal action that allows injured parties to seek compensation for their damages and to hold at-fault parties accountable for their wrongdoing. In a motor vehicle collision, an injured party may bring a claim against a negligent motorist and the insurance carrier that represents that party. Eligible claimants may be reimbursed for pain and suffering, wage loss, medical costs, etc. In head-on collision cases, traumatic injury or even death may occur. A grieving family may have options in their situation.
Surviving family members may have grounds for a claim for wrongful death if their loved one suffered fatal injuries in a crash caused by another party’s negligence or carelessness. Any tragic incident caused by another individual or entity’s negligent or reckless actions may constitute wrongful death. This may include a motor vehicle collision and other types of accidents. Only specific survivors of the decedent can file for wrongful death in California. Those with priority include the surviving children, domestic partner, or spouse. Others may be eligible based on the facts of the matter.
California law imposes a statute of limitations, or strict filing deadline, on personal injury and wrongful death cases. Both are generally subject to a two-year time limit. The two years usually start on the date of the incident. It is essential to seek the assistance of an experienced California personal injury lawyer like ours at AutoAccident.com.
