Accident Near Isleton Claims One Life Following Two-Vehicle Crash

A fatal accident was reported on March 28 in Sacramento County along Highway 12 at Jackson Slough Road. Officers with the California Highway Patrol (CHP), paramedics, and firefighters arrived at the scene south of Isleton around 3:30 in the afternoon near Terminous Road to discover that two vehicles had collided. One of the vehicles went off the roadway and down a drainage ditch as a result of the impact.

Further Details About the Fatal Accident

One person died in the collision. The highway was shut down by authorities as an investigation into the cause of the fatal accident ensued. The name of the deceased individual has not yet been released pending notification of the family.

Eligibility for a Wrongful Death Claim

Members of the deceased’s immediate family can file for wrongful death when negligence was the cause, which includes the following:

  • The surviving spouse, domestic partner or putative spouse can file a claim. A putative spouse is someone who believes they were legally married. In California, some immigrants arrive and are married in their own country. However, that marriage may not be recognized in California.
  • Children from the marriage, including those who lived in the house for six months and received at least half their support from the decedent can be included in the claim.
  • Children belonging to a deceased offspring of the decedent are eligible to file.
  • In the event the decedent died without a partner, spouse, or children, others in the family may file, including parents and siblings.

Losing a Loved One

The loss of a loved one leaves the family not only filled with grief but wondering why it happened to them. They are confused, angry and wonder how they will cope with that loss. Although it is probably the last thing on their minds, eventually, financial considerations come into mind with the loss of earnings and funeral and burial expenses.

How a Wrongful Death Lawsuit Helps

That’s where a wrongful death lawsuit comes in. Over the years, we’ve helped many families obtain the compensation they deserve. Although it won’t ease their suffering, it can give them a measure of peace and justice for that loss by knowing that financial considerations are one thing they don’t have to worry about. Families are able to recover the following:

  • Loss of financial support in the future, which includes wages, bonuses, insurance, retirement, and others until the decedent would have reached the age to collect a pension.
  • Loss of inheritance is covered.
  • Expenses for the funeral and burial can be recovered.
  • Loss of household services, which are things the decedent normally performed around the home such as lawn and child care, meal preparation, and taking children to and from school, can be recovered.
  • Loss of comfort, affection, moral support, companionship, and consortium with the spouse is recoverable.
  • For the children of the family, loss of training, guidance, and care as a parent can be recovered.
  • In the event the decedent lived for a while and received medical care before they expired, a survival action can be filed to recover those costs.
  • Punitive damages may be recovered in some cases where the death was intentional or egregious such as being caused by a drunk driver. Punitive damages are often much higher than those awarded in a wrongful death claim and are separate.
