How Negligence Can Cause a Wrongful Death
A wrongful death occurs when someone dies in an accident that was caused by a negligent person or other entity. Some of the most common causes of wrongful death in a car accident include:
- Drunk or drugged driving: Those who are under the influence of alcohol or drugs cannot drive safely, which may lead to a fatal accident.
- Fatigue: Being overly fatigued has been compared to drunk driving in the effect it has on the person behind the wheel of the car. Slowed reaction times and even falling asleep are common causes of a collision.
- Speeding: When a driver is speeding, their vehicle requires a much longer distance in which to stop. In addition, the driver is more apt to lose control of their vehicle, which can lead to a fatal accident.
- Distracted driving: Whether texting, talking on a cell phone, changing a radio station, or other activities, the one thing they all have in common is they cause the driver to be distracted. Since in the five seconds it takes to send a text message, a vehicle can travel as far as the length of a football field, it is easy to see how a fatal accident can occur.
- Running a red light: Red light and stop sign runners run the risk of T-boning another vehicle or striking a pedestrian or bicycle rider in the crosswalk when they race through an intersection.
- Failure to yield the right of way: Failure to yield is a common cause of a fatal accident, especially at intersections.
- Tailgating: Tailgating is a common cause of rear-end collisions. While many of these collisions result in minor injuries, if the vehicle in front is pushed into traffic, it can cause a fatal accident.
