When an Accident Results in Wrongful Death
A family who has lost a loved one due to negligence deserves justice. Attorneys who know how the law works and what you and your family need can assist your family with filing a wrongful death claim. An injury attorney should be consulted if you believe the negligence of another person or entity contributed to your loved one’s death.
Bicycle Accidents Caused by Negligent Drivers
Automobile accidents caused by negligence are the most common type of collision with a bicycle. Accidents involving bicycles often result from negligent behavior by drivers, resulting in injuries or fatalities. A bicycle accident can be caused by any of the following factors:
- Distracted driving
- Tailgating
- Speeding
- Hit-and-run
- Running a red light or stop sign
- Failing to yield the right of way
Investigating to Collect Evidence
An injury lawyer will investigate a case once they have identified the accident may have been caused by another driver’s negligence. In this process, witnesses will be interviewed, and evidence will be collected as much as possible. To build their case, investigators may use various techniques according to the severity of the crime.
- Witnesses: Witnesses are often a valuable source of information in any case. Witnesses can report how they saw the accident occur, whether the vehicle was at fault in the fatal bicycle accident and other information.
- Reconstruction of the fatal bicycle crash: In the aftermath of an accident, accident reconstruction experts can assist lawyers in discovering what happened. The use of special techniques, such as measuring skid marks and other indicators of speed and direction, can also help accident reconstructionists determine who was at fault.
- Expert Witnesses: A lawyer may hire an expert witness to support their case with their testimony. Lawyers can use them to establish facts such as who was at fault and whether a particular party must be held accountable.
- Other evidence: In addition to accident scene photos, the police report and other information, the lawyer may also examine other evidence. Depending on where the accident occurred, surveillance cameras might have captured it.
A strong case will then be built against the driver who caused the fatal bicycle accident based on all of this evidence and testimony.
