What Families Should Know About Wrongful Death Truck Accident Cases
When a big rig is involved in a traffic collision with a passenger vehicle, it is often the smaller car that faces catastrophic consequences. That is because a passenger vehicle is no match for a large commercial truck, given its overwhelming weight and size. The occupants of the smaller cars are likely to suffer serious injuries because of this significant difference. In some extreme cases, loss of life may occur. When a family loses a loved one in a tractor-trailer crash, a wrongful death claim may be brought against the party or entity responsible for the loss. These may include a negligent truck driver, trucking company, parts manufacturer, truck manufacturer, and more.
In a wrongful death claim, surviving family members may seek compensation for loss of services and support, loss of protection and companionship, mental anguish, funeral service expenses, lost future financial support, costs of medical treatment for the final injury sustained in the big rig crash, and more. It is essential to note that the value of a wrongful death case for a truck accident is dependent on the facts and circumstances involved. Therefore, the amounts may vary on whether the case is resolved through settlement negotiations or what a jury decides. Remember that there is a two-year statute of limitations to filing a lawsuit in civil court. Waiting too long may result in the dismissal of the case by the court and the loss of the right to take legal action.
