Things to Know About Big Rig Crashes and the Claims Process

The loss of a loved one is devastating enough, and finding out that someone else is to blame may compound the grieving process with anger and frustration. While coming to terms with the loss of a close relative, surviving family members must endure so many challenges all at once. There is the sudden shock if the loss was unexpected, potential financial hardship without the support of the decedent, and emotional pain. While bringing a wrongful death claim may be the last thing on the minds of grieving survivors, taking the action to consult with an experienced attorney immediately is essential. There is a strict deadline that must be met for such cases and failing to file within the two-year statute of limitations may prevent survivors from seeking justice and fair compensation for their loss.

Determining negligence is key in any commercial truck accident case. The reason is that these vehicles are regulated by strict federal and state laws. Trucking companies and truck drivers are held to higher standards when it comes to road safety. When they fail to meet their obligations and cause an accident resulting in serious injury or death, the stakes may be high. In some cases, several parties may be held liable for damages incurred. It will take the assistance of an experienced Keyes truck accident lawyer to conduct an independent investigation of the incident and figure out what happened. This way, each party may be held financially accountable for their contribution to the big rig crash.

When you are searching for the right attorney to represent you, you should look for one that you feel most comfortable with given you will be working with them throughout your case. Cost should not deter people from retaining legal counsel. Most injury lawyers handle truck accident cases under a contingency fee arrangement, meaning that no upfront costs are due. Clients will only pay if their attorney obtains a favorable case outcome on their behalf. A top attorney will answer any of your questions, go over the details of your case, and what to expect from the process moving forward. For more details on truck accident cases, watch this video.

Importance of Retaining Legal Counsel After a Big Rig Crash

After a tractor-trailer accident, the insurance company representing the other party may make a quick settlement offer. What injured parties and families of decedents should keep in mind is that these cases often result in life-changing consequences with emotional, physical, and financial challenges that may last a lifetime. You may be entitled to more compensation than the lowball settlement offer the insurer may extend to you. It is essential to not only focus on existing bills when considering settling your case but also how future bills may impact your situation, and most offers do not account for the future.

Most truck accident cases involve significant losses. Most claims are intended to seek recovery of past, present, and future costs that are reasonably expected to incur. In terms of a wrongful death case, survivors may seek recovery of economic and non-economic damages. Economic damages refer to financial costs like funeral expenses, lost income, and medical bills. Conversely, non-economic damages consider subjective types of harm such as mental anguish and loss of companionship.
