Fatal Car Accident at Fresno County Intersection
The California Highway Patrol (CHP) reported a recent fatal car accident at an intersection in rural Fresno County. The motor vehicle collision occurred at approximately 3:30 p.m. at West Lincoln Avenue and South Brawley Avenue just west of Easton. CHP traffic officials said a 46-year-old man was driving a Ford Expedition with two passengers, a 4-year-old girl, and a 45-year-old woman. The Ford was headed westbound on Lincoln Avenue. At the same time, a man was driving a brown Nissan Altima north on Brawley Avenue.
The Ford and the Nissan reportedly collided at the intersection, resulting in minor injuries to the three people in the Ford. All three parties were taken to Community Regional Medical Center for treatment after the Fresno car accident. Sadly, the Nissan driver succumbed to his injuries at the scene. The Fresno County Coroner’s Office has identified him as 71-year-old Gurnam Singh of Fresno.
Losing Someone You Love
The loss of a close relative is the most devastating type of trauma a family may experience. The thought that someone else’s negligent or careless actions contributed to that loss makes the tragedy even more challenging to cope with.
While nothing can undo the pain of losing a loved one or bring them back, our Fresno wrongful death attorneys can help you and your family obtain a sense of justice by holding the at-fault party financially accountable for your loss and damages incurred. Do not allow insurance companies to tell you how to handle the loss of your loved one nor take advantage of your vulnerable situation. Speak with a skilled lawyer today to understand your legal rights and options for recovery in your case.
Who is Eligible for Wrongful Death Damages in California?
When someone else’s negligent or reckless behavior results in a loss of life, specific surviving family members may bring a wrongful death claim. The sole purpose of a wrongful death action is to compensate survivors for their loss and damages incurred.
Under the California Code of Civil Procedure Section 377.60, the surviving spouse, domestic partner, or children of a deceased person may file a claim for wrongful death. Compensation may be awarded for medical expenses, lost earnings, funeral bills, mental anguish, and lost companionship, care, and guidance. If there is no surviving domestic partner, spouse, or children, the decedent’s putative spouse, parents, putative spouse’s children, and stepchildren may bring the case.
What is the Filing Deadline for Wrongful Death Actions in California?
If you believe you have a claim, speak with a Fresno wrongful death attorney immediately. Specific criteria deadlines apply to wrongful death actions in California, and an attorney can ensure none are missed in your case. One of which is the strict two-year statute of limitations, which requires a lawsuit to be filed in civil court if a wrongful death settlement is not accepted from the insurance company within the deadline.
Your lawyer will also help by increasing your chances at fair compensation in the face of challenging rules and regulations regarding survivorships and wrongful death cases.
