Bringing a Personal Injury or Wrongful Death Claim for an Auto Accident
An individual who is injured or loses a family member in a car wreck may be entitled to compensation through a personal injury or wrongful death claim against the party who caused the crash. A driver or entity may be liable for a traffic collision due to their recklessness or negligence. If another driver crashes into another vehicle, then that motorist may be deemed negligent if they were speeding, driving while impaired, running a stop sign or red light, texting while driving, did not have their headlights on at the time of the incident, or committed other traffic violations.
A successful personal injury or wrongful death claim requires clear and compelling evidence that another party caused the accident and the resulting damages occurred from that incident. Evidence to gather and build a strong case may include medical records, traffic incident reports, eyewitness testimony, pictures of the crash site, video surveillance footage, photos of the vehicle damage, and more. Without evidence, it may be challenging to connect the incident to the subsequent injury or death. As such, it is essential to gather and preserve evidence in its entirety before it is altered or destroyed.
If you were injured or lost a family member in a motor vehicle collision because of a negligent motorist or entity, you may be considering legal action. The statute of limitations in California for personal injury and wrongful death is two years. This is by CCP 335.1. The statute of limitations refers to the amount of time that an individual is allowed to file a case in court. Specific exceptions may apply, particularly in cases involving a public agency. The deadline is six months instead of two years, according to the California Government Code Section 911.2.
Seeking Compensation in a Car Accident Case
Recoverable damages refer to the financial losses and intangible harm experienced by the claimant and the payments they may receive from the at-fault party. The value of a claim will depend on the specifics of the case and the costs the claimant has had to date and is likely to incur in the future. Recoverable economic and non-economic damages in injury cases may include wage loss, medical treatment costs, pain and suffering, and more. In wrongful death cases, survivors may be compensated for loss of financial support, loss of companionship, funeral costs, mental anguish, and other associated losses.
