How Can a Wrongful Death Claim Help a Family After a Devastating Accident?
Large commercial trucks are an essential part of the economy in California and throughout the nation. However, with each load, the trucker and trucking company must exercise a duty of care to prevent a tragedy from occurring on public roads. When a big rig is involved in a collision with a passenger vehicle, the results are often catastrophic for those riding in smaller vehicles. An 18-wheeler may generate a significant force of impact in an accident and the survivors of such crashes may be left with spinal cord injuries, bone fractures, TBI, and other life-changing trauma. In some extreme cases, they may result in loss of life. When this occurs, a family may have grounds for a wrongful death claim. These are generally brought against a negligent driver and their insurer for a fatal crash. In the case of a semi-truck wreck, multiple parties may be found at fault aside from the trucker, including the trucking company, the manufacturer of the 18-wheeler, and more.
A fatal big rig crash is not like a car accident because of the various state and federal laws that oversee the trucking industry. Therefore, it takes a dedicated Modesto wrongful death lawyer to navigate the challenging claims process. This includes working with expert witnesses to determine the sequence of events leading up to the 18-wheeler accident and building a strong case for maximum compensation. Seeking financial recovery in a wrongful death claim for a commercial truck accident is not always easy. However, when you have the right attorney at your side, your family can rest assured knowing that your rights and best interests will be protected every step of the way.
