Fatal Car Accidents and Wrongful Death Actions
One of the most devastating events that may occur in a family is the loss of a loved one, particularly when it was sudden and caused by the negligence of another party or entity. When this occurs, surviving family members may have the right to take legal action against the negligent party or entity. This may be accomplished through the filing of a wrongful death claim against them and their insurance company. While it may be challenging to consider bringing such a case forward while dealing with grief and unexpected expenses, it is essential to understand that the purpose of these cases is to make a family whole again in the form of compensation. It may also provide a sense of justice and closure that survivors need knowing that the other side has been held accountable for the undue harm their negligent actions have caused.
California law is specific on which relatives may bring a wrongful death matter forward. Under the California Code of Civil Procedure Section 377.60, the surviving spouse, domestic partner, and children are entitled to bring such cases forward. If such relatives are non-existent, other close family members may be eligible for filing. Recoverable damages through these cases reflect the intangible harms and financial consequences the family has suffered because of the loss of their loved one. This may include funeral service costs, medical treatment expenses incurred before death, loss of future earnings and inheritance, lost benefits like retirement and pension plans, mental anguish, and more. An experienced Merced wrongful death lawyer can help surviving family members determine the full and fair value of their claim. For additional information on these types of cases, watch this video.
