How Can a Wrongful Death Case Help Surviving Family Members?

The sudden loss of a close relative may leave a family devastated in a wide array of ways. While it is natural to only consider the emotional consequences of the loss, there are other concerns that should be addressed. Without the financial support provided by the decedent, for instance, the family may find it challenging to make ends meet. This is especially true if the deceased was the primary provider of the household. Fortunately, California law allows specific surviving family members the opportunity to seek reimbursement for financial losses in addition to intangible harm. This may be accomplished through filing a wrongful death claim against the other side and their insurance carrier.

To bring a successful claim forward, there must be clear and compelling evidence of underlying liability. In other words, the other side acted in a way that was negligent and caused the loss of life at issue. In most cases, damages for loss of future financial support, funeral service costs, medical bills, and lost benefits are recoverable. Mental anguish and loss of care, companionship, and support fall under non-economic damages, which may be available through these cases as well.

In the wake of a tragic loss, it can be challenging to consider taking legal action against the party responsible for the devastating event. However, families facing such situations may obtain a sense of justice knowing that the negligent individual or entity has been held accountable for the loss of their loved one and damages incurred. It is essential to work with an experienced Merced wrongful death attorney who can help secure the maximum compensation your family deserves after the tragic loss of a close relative. Having an accident lawyer on your side means that you and your family will have the time to grieve and recover while your attorney handles all aspects of your claim.
