Losing a Loved One in a Fatal Motor Vehicle Collision

The loss of a loved one is always devastating regardless of the circumstances. But the grief from the loss may be compounded by anger and frustration when that loved one’s life was taken away because of someone else’s negligence. Fortunately, California law protects surviving family members by giving them the right to bring a wrongful death claim. While no amount of money can undo the pain from losing a close relative, the case may hold negligent parties financially accountable for damages incurred. It may also offer a sense of justice that survivors rightfully deserve.

Under the California Code of Civil Procedure Section 377.60, specific surviving family members may seek recovery of damages incurred. The surviving spouse, domestic partner, and children generally have priority when it comes to filing a claim. This is then followed by the putative spouse, parents, stepchildren, and putative spouse’s children if such parties are nonexistent and they can prove they were dependent upon the deceased.

For a wrongful death case to be successful, it must be proven through compelling evidence that the crash resulting in death was the direct result of another party or entity’s failure to take action or negligence. A person may be considered negligent in situations where they would fail to act in the same way a reasonable individual would. In cases where the government entity failed in the design and maintenance of the public roadway in which the accident occurred or a vehicle fails to meet federal safety guidelines, it may be appropriate to bring a wrongful death action against the municipality or automaker.
