What You Should Know About Fatal Accidents and Wrongful Death Claims
When someone else’s recklessness or negligence causes a fatal motor vehicle collision, they may be held financially accountable for resulting damages through a wrongful death claim. An attorney experienced in handling these types of cases may assist surviving family members in bringing their claim and recovering fair compensation on their behalf. Depending on the facts and circumstances of the case, the at-fault party or entity may be a negligent driver, vehicle manufacturer, or municipality responsible for the design and maintenance of the public road.
When a wrongful death car accident occurs, survivors such as the spouse, domestic partner, or children may file a claim against the party responsible for the incident. This is by the California Code of Civil Procedure Section 377.60. Other relatives may also file for wrongful death if the parties previously mentioned are non-existent. This may include surviving parents, stepchildren, putative spouse, and putative spouse’s children.
A wrongful death claim is challenging, to say the least. That is why it is essential to retain an experienced attorney to handle it. A lawyer with years of experience handling such cases will take the time to listen to survivors’ stories through a free consultation, advise them of their potential rights in a wrongful death case, and take the steps necessary in ensuring they receive the fair compensation they rightfully deserve. Types of Compensation in a Wrongful Death Car Accident Case
In the unfortunate event of a fatal car accident, bringing a wrongful death claim may help survivors seek recovery of economic and non-economic damages. Of course, no amount of money can undo the pain of losing a loved one, but it can help surviving family members cover the financial hardship that comes with an unexpected death in the family. Through this type of case, surviving family members may recover:
- Expenses for end-of-life medical treatment related to the car accident
- Costs of funeral and burial services in memory of the lost loved one
- Loss of affection, care, and companionship for surviving family members
- Lost future financial support, particularly if the decedent was the provider of the household
- Mental anguish from the loss of a loved one in a wrongful death car accident
An attorney experienced in wrongful death car accident cases can help surviving family members throughout the legal process. This includes determining negligent parties, bringing a claim against the insurance company representing the at-fault party, handling first-party claims through uninsured and underinsured motorist coverage (UM and UIM), and if there were any other parties or factors that led to the fatal incident.
