What is a Wrongful Death Claim and How Can it Help a Family?
Coming to terms with the loss of a loved one is never easy, particularly if it occurs without warning and is the result of someone else’s negligence. A family going through such situations may take legal action against the other side through a wrongful death claim. In the case of a deadly crash, a claim may be brought against the negligent party and their auto insurance provider. Economic and non-economic damages may be recovered through these claims for financial and intangible losses. Surviving family members may seek reimbursement for losses such as medical and funeral costs, loss of affection, care, and love, lost future financial support, and more.
Generally speaking, surviving family members must bring a wrongful death lawsuit in California no later than two years from the date of the fatal incident. This deadline is also known as the statute of limitations. Bear in mind that specific exceptions may apply. For instance, if a wrongful death claim names a government entity as a defendant, survivors must file a notice of claim within 180 days. Failure to meet the statute of limitations may result in the dismissal of the case by the court. For more information on the claims process, watch this video.
