Details on the Fatal Car Crash on Orange Blossom Road in Oakdale

The Stanislaus County Sheriff’s Office received an initial report of a car accident at approximately 3:15 p.m. The California Highway Patrol, county officials, and first responders responded to the scene and located an SUV that was partially submerged in a pond along the river.

The driver, an 18-year-old woman from Stockton, was transported via air ambulance to an area hospital for immediate treatment. Sadly, she succumbed to her injuries during hospitalization. Officials have not yet released her identity. The passenger, a 20-year-old Oakdale woman, suffered minor injuries and was treated at Memorial Medical Center in Modesto.

CHP traffic officers indicated in a preliminary report that both parties were wearing seatbelts. It was unclear whether any other parties were involved in the crash as it was initially described as a single-vehicle collision. Additional details on the fatal car accident on Orange Blossom Road have not yet been released by police due to an ongoing investigation.

Can I Bring a Claim for a Rollover Accident?

A rollover collision may result in serious injury or even death to those involved. That is because this type of auto accident generally causes violent movement that may lead to the development of traumatic injuries such as those affecting the spinal cord, internal organs, brain, and more. In some extreme cases, injuries may prove so severe that they may lead to a loss of life. In either of these situations, a claim may be brought against an at-fault party for economic and non-economic damages in connection with the incident. For personal injury, this may include pain and suffering, medical bills, lost earnings, and other losses. Conversely, costs of funeral service arrangements, lost future financial support, loss of companionship, and other losses may be recoverable in a wrongful death claim. A survival action may be brought to seek reimbursement of costs related to the treatment of the decedent’s final injury.

To bring a successful rollover collision case forward, negligence must be proven on the part of the other party that directly caused the injury or death and that this directly resulted in damages. To do so, it is of utmost importance that evidence is collected and preserved immediately. That is because a rollover accident involving one vehicle may be attributed to causes other than driver error, such as a road defect or faulty car equipment. Government entities are required to ensure that public roads do not present any hazards to drivers and other roadway users. A road may be considered dangerous because of a defect in roadway design like insufficient warning signage and inadequate guardrails or insufficient maintenance like potholes and sinkholes. Conversely, an automaker that designs and manufactures a vehicle that fails to uphold the standard set forth in the Federal Motor Vehicle Safety Standard 216 may be held liable for any injuries exacerbated because of insufficient roof crush resistance.

To proceed in any of these situations, remember that evidence is key. For a government entity claim, it is essential to have a road defect well-documented through photo and video evidence. This must be done immediately as a claim must be filed no later than 180 days from the incident date. In the case of insufficient roof crush resistance or another defect that is attributable to a rollover, the vehicle in question must be kept and preserved for an expert witness to evaluate. Bringing a claim against an automaker or public agency may be challenging as there are strict criteria and deadlines involved.
