Filing for Compensation in a Wrongful Death Claim

If your loved one’s death was caused by another driver’s negligence or another party’s fault in a fatal collision involving two vehicles, immediate family members have the right to file a wrongful death claim. The right to file primarily extends to the spouse or children of the deceased. In the absence of a spouse or children, the parents and siblings of the deceased may pursue the claim. Possible damages that can be sought following a fatal accident in Woodland include:

  • Lost income and benefits that the deceased would have earned until retirement, such as insurance and pension benefits.
  • Expenses incurred for funeral, burial, or cremation services.
  • Compensation for the loss of affection and companionship suffered by the surviving spouse.
  • Reimbursement for the loss of parental care and guidance experienced by the children.
  • Claims for the loss of household services that the deceased provided.

Filing a wrongful death claim can help ensure that those left behind are financially protected and can cover the unexpected costs associated with the loss of a loved one.

Proving Fault in a Fatal Accident

To prove fault in a fatal collision involving two vehicles, an accident lawyer typically follows a comprehensive process involving several key steps, such as the following:

  • The lawyer conducts an extensive investigation to gather all relevant evidence, including police reports, witness statements, and any available surveillance footage.
  • They might collaborate with accident reconstruction experts to recreate the scene and establish how the incident occurred. Additionally, the lawyer will examine the background and actions of all parties involved to uncover any negligence or recklessness contributing to the accident. Medical records and expert testimonies are also crucial in demonstrating the cause of death and linking it directly to the accident. By meticulously piecing together this evidence, the lawyer aims to build a compelling case to establish the responsible party’s liability.
