Can You Seek Compensation for Losses from a Traffic Collision?
Suffering injuries or losing a loved one in a traumatic accident is painful and devastating. When the incident was the result of someone else’s carelessness or negligence, it is particularly challenging for parties dealing with serious injuries or surviving family members who must carry on without their close relatives. Fortunately, injured parties and families of decedents may have grounds for a claim for damages against the at-fault party. If it has been determined that the other side has limited to no insurance, claimants may seek reimbursement through their insurer if they carry uninsured/underinsured motorist coverage. Is There a Filing Deadline on Accident Cases in California?
According to the California Code of Civil Procedure Section 335.1, an individual entitled to file a personal injury lawsuit must do so within two years of the date of the accident. The same statute of limitations also applies to wrongful death cases. Failure to file within this period may result in the court’s dismissal of the matter. This may ultimately lead to the loss of the right to hold the at-fault parties liable for damages incurred. Therefore, it is essential to ensure that all filing criteria and deadlines are met in these cases. An experienced California personal injury attorney can help by ensuring that the case is filed in civil court in a timely manner and in the appropriate jurisdiction.
