Details on the Fatal Crash on River Road Near Oakdale

Officials responded to a report of a single-vehicle accident involving a Dodge van on River Road just west of Oakdale. When CHP traffic officers arrived at the scene, they located one party deceased at the crash site. Authorities identified the decedent as 31-year-old Oakdale resident Paige Henderson.

Authorities conducted an investigation into the solo car crash and located a 26-year-old Oakdale man walking along River Road approximately half a mile away from the accident scene.

Things to Know About Wrongful Death Cases for Car Accidents

It is always tragic when a family member passes away. However, a loss of life is even more painful when a loved one dies prematurely or unnecessarily in an accident caused by another party’s negligence or carelessness. While no amount of money may make things right again for surviving family members, they may be entitled to financial compensation for economic and non-economic damages suffered because of a loved one’s wrongful death.

The deceased individual’s age, past earnings, expected future earnings, occupation, education, health before the fatal incident, and life expectancy at the time of their passing may be considered. Recoverable losses may include loss of the deceased’s financial contributions to the family household, lost benefits, mental anguish suffered by survivors, loss of companionship, funeral service costs, expenses for end-of-life treatment (via survival action), and more.

If a mutual settlement agreement is not reached with the other side and insurance companies, a lawsuit must be filed in court to protect your rights. For most wrongful death cases in California, a two-year statute of limitations generally applies. Given that there is substantial time and effort involved in building these cases, it is crucial to work with a skilled California wrongful death attorney. Do You Need an Attorney to Bring a Wrongful Death Car Accident Case?

In every fatal car accident case, it is recommended that surviving family members consult with an experienced California accident lawyer. Navigating these cases may be challenging given that insurance companies may make the recovery process difficult for survivors as a way of protecting their bottom line.

Insurance carriers are known to resort to defense tactics to maximize profit margins. Unfortunately, this may come at the cost of families like yours dealing with the loss of a loved one after a fatal traffic collision. Insurers may pinpoint liability on the decedent and use other defense tactics to devalue or deny a payout.

It is crucial to retain legal counsel since an independent investigation into a fatal incident may reveal other potential defendants who may be held accountable for the loss of life and paying damages. For more information, reach out to an experienced attorney in your area for a free consultation.
