What You Should Know About Motor Vehicle Collisions and Wrongful Death Claims
A wrongful death claim may arise when an individual has lost their lives in an accident caused by the reckless or negligent act of another party or entity. This is a civil action taken to hold the at-fault party financially responsible for damages related to the loss of life and lasting impacts on survivors.
When an insurance adjuster contacts a surviving family member for a recorded statement or to extend a settlement offer, it is essential to keep in mind that the insurer has no interest in providing full and fair compensation for damages incurred. The unfortunate reality is that the role of the claims adjuster is to limit recovery to protect the insurance company from financial liability.
Fortunately, an experienced Antioch wrongful death lawyer is prepared to represent survivors’ best interests in negotiation or litigation against the insurance company representing the at-fault party. Who is at Fault in a Rollover Accident?
In the case of a single-vehicle accident, it is possible that a government entity may be responsible for the incident. This may be for a road defect stemming from inadequate design or failure to maintain the road.
An automaker may also be responsible for a solo-car rollover if the roof of the vehicle failed to meet Federal Motor Vehicle Safety Standard 216 on roof crush resistance. It must be proven through an auto products liability claim that this resulted in an exacerbation of injury or fatality. For more details on what types of evidence are necessary for establishing liability in a fatal rollover accident, contact an experienced wrongful death lawyer today.
