Wrongful Death Claims for Passengers Killed in Crashes

When a family is deprived of a close relative due to a motor vehicle collision caused by negligence, they may be entitled to compensation for their loss through a wrongful death action. In the context of a passenger fatality in a single-vehicle accident, surviving family members must prove that the driver of the involved car was responsible for the incident that claimed the passenger’s life. Clear and compelling evidence must demonstrate driver negligence, such as speeding, texting and driving, driving under the influence (DUI), and other careless driving behaviors.

The case file an attorney puts together and presents to the insurance company representing the other side and defense counsel may contain documents proving the reasonable and necessary value of damages. It may also include photos of the location where the incident occurred, pictures of property damage, video surveillance footage, police reports, and other evidence establishing liability and negligence. To build a strong case for full compensation, an attorney will include medical records, autopsy reports, eyewitness statements, expert testimony, family photos with the deceased, and more.

Is There Enough Insurance for a Wrongful Death Car Accident?

While it may be challenging to put a value on a loss of life from a car wreck, it is necessary to provide surviving family members with the means for a more secure future, particularly if the decedent was the primary provider of the family household. As such, it is helpful for survivors to have an attorney on their side who can conduct an in-depth investigation to identify liable parties and potential avenues for financial recovery. If the at-fault driver has limited to no coverage, the deceased’s UM and UIM protection may cover death-related losses.
