Recoverable Damages in Wrongful Death Car Accident Cases
No amount of money can undo what has occurred, but holding an individual or entity accountable for their actions by bringing a wrongful death claim in California is essential for surviving family members. These cases may bring justice and a sense of closure to survivors in that the defendant has been held liable for their wrongdoing and the losses their actions have caused. Eligible claimants may be compensated for economic and non-economic damages. These include funeral costs, mental anguish, loss of financial support, medical bills (in a survival action), loss of companionship, etc.
A court may award the family punitive damages if the other side engaged in egregious conduct leading up to the fatal incident. Punitive damages are not intended to compensate surviving family members. They are only meant to punish the negligent party and deter other individuals from doing the same in the future. In a fatal motor vehicle collision, punitive damages may be warranted if the crash occurred due to excessive speeding or DUI. There must be clear and compelling evidence demonstrating that the fatal accident was due to egregious conduct.
Many individuals lose their lives in head-on collisions due to serious injuries. Surviving family members must prove that a close relative would still be alive if the other side acted cautiously, safely, and reasonably. How is a Wrongful Death Case Proven?
To successfully prove a wrongful death action, an attorney must prove four elements. These include the fact that the other party owed a duty of care to the decedent, the other side breached their duty of care, the defendant’s breach of duty was the proximate cause of the loss of life, and the family suffered damages due to the negligent party’s breach of duty. Using evidence collected in an independent investigation, the California wrongful death lawyer handling the matter will establish that the at-fault party’s negligence caused the car accident and the death of a loved one. This includes:
- Police and autopsy reports
- Statements from eyewitnesses
- Photos and videos of the crash site
- Medical records if the deceased was hospitalized for final injuries
- Expert witness testimony, such as an accident reconstruction specialist
