How a Wrongful Death Claim Can Help Surviving Family Members
It is devastating and painful to suddenly lose a loved one in a traffic collision. It is more challenging when it is found that the incident resulted from another party’s carelessness or negligence. When this is the case, survivors deserve justice. The other side may be held accountable for their actions and the damages incurred through a wrongful death claim. These claims are generally brought against the negligent driver and their insurer in a fatal car wreck. A claim through uninsured and underinsured motorist coverage may be in order if the at-fault party has insufficient coverage or no insurance.
In California, there is an order of priority for which surviving family members can file. If there is no surviving spouse, domestic partner, or children, the relatives eligible for filing include the parents, putative spouse, etc. Other relatives who depended on the deceased for financial support may also be eligible. This will depend on the facts and circumstances of the matter. In most cases, survivors have a maximum of two years to file in civil court. This deadline may be shortened in some instances, such as those that name a public agency as a defendant. In these cases, a six-month time limit applies.
