Loss of a Loved One in an Accident

For families who have experienced the loss of a loved one in a fatal accident caused by someone else’s negligence, finding a way to move forward may be challenging without obtaining justice. In such situations, the family may bring a wrongful death claim against the party responsible for the loss. When the case involves a hit and run driver, survivors may bring a claim under their uninsured motorist coverage, or that of their deceased loved one. This type of coverage pays for damages arising from hit and run crashes involving cyclists and pedestrians and may extend to other family members in a household, so long as they are not listed as excluded members.

In wrongful death pedestrian accident cases, the decedent’s surviving spouse, domestic partner, or children have priority to bringing a case forward. This is by the California Code of Civil Procedure Section 377.60. Other family members may bring a claim if such parties are nonexistent, including the deceased person’s parents, stepchildren, and other relatives listed under CCP 377.60. It is essential for close relatives to understand that such cases may be subject to a strict filing deadline known as the statute of limitations which is two years from the date of loss in California.

No amount of compensation may ever compensate surviving family members for losing someone they love. However, a skilled Modesto accident attorney has the experience and resources to help survivors seek the compensation they need to cover costs of medical treatment related to final injuries, funeral service expenses, lost financial support, and other losses.
