Things You Should Know About the Wrongful Death Claims Process
The loss of a loved one is devastating and overwhelming for surviving family members. If the loss resulted from a hit-and-run accident, an independent investigation of the incident is necessary to determine the cause and identify the at-fault party. This must be done quickly and effectively as evidence necessary in identifying the suspect driver may be lost or destroyed over time.
In a wrongful death claim for a pedestrian accident, there are two types of recoverable damages from the at-fault party. They include economic damages in which account for financial losses, whereas non-economic damages consider intangible ones. These include medical bills, funeral costs, lost future earnings, loss of companionship, mental anguish, and more. Such claims for damages are generally filed against the insurance company representing the at-fault party. In cases of hit and run pedestrian accidents, survivors may turn to their insurer for recourse if they have uninsured and underinsured motorist coverage. Such coverage may pay out claims up to the limits of the policy, depending on the facts and circumstances involved in the case.
It is essential to keep in mind that claims adjusters may attempt to extend a lowball settlement offer to surviving family members in hopes of them accepting without realizing the full extent of resulting losses. An experienced Modesto wrongful death attorney may help survivors in seeking the fair compensation they are entitled to from insurance companies. If all attempts at a fair settlement fail with the insurer, the attorney will take the case to civil court for a jury to decide an appropriate award, if necessary. Who Can File a Claim for Wrongful Death in California?
Claimants of wrongful death damages may include the surviving spouse, domestic partner, and children if any. Other members of the family may recover compensation if the decedent had no children and was not married. Under the California Code of Civil Procedure Section 377.60, the parents, stepchildren, putative spouse, and putative spouse’s children may have a claim to financial recovery. Minor children who lived with the deceased person for at least 180 days and depended on them for financial support may also be compensated for their loss.
More than anything, successful outcomes of wrongful death cases may provide a sense of closure for survivors who have lost close relatives due to the negligent or reckless acts of others. They also serve as a message to the community that such behavior will not be tolerated. Working with an experienced attorney is crucial in this process as a lawyer will know the best way to proceed in the case by holding at-fault parties financially accountable for damages incurred.
