What is a Wrongful Death Claim?
When a close relative loses their life in an accident caused by another individual or entity’s negligent actions, California law makes it clear that at-fault parties must be held accountable for the consequences of their wrongdoing. In the case of a fatal single-vehicle accident, a claim may be brought against the negligent driver for resulting losses.
If the incident occurred from other causes, like road defects or faulty vehicle equipment, a family may have grounds for a government entity claim or products liability claim. Keep in mind that a six-month statute of limitations applies to claims involving public agencies, per California Government Code Section 911.2.
What is the Purpose of a Wrongful Death Case?
In California, a wrongful death claim is intended to compensate a family for financial and intangible losses incurred from their loved one’s sudden death. This may include compensation for the loss of the deceased’s income, support, guidance, companionship, care, and protection. It may also include reimbursement for medical and funeral expenses, mental anguish, and more.
Under CCP 377.60, the deceased’s spouse, domestic partner, or children have priority to file wrongful death matters. Other family members may be eligible for filing if these relationships with the decedent do not exist.
