Filing a Claim for Wrongful Death
In California, a wrongful death claim can be filed either by the estate of the deceased or by immediate family members such as the spouse and children. In some cases, the decedent had no spouse or children. In these instances, the parents and siblings may be able to institute a wrongful death claim to recover damages.
Understanding Wrongful Death Claims and Potential Compensation
When a loved one passes away in a fatal Modesto collision due to someone else’s negligence or wrongful act, certain family members may have the right to file a wrongful death claim. If there is no immediate family, siblings or parents may step forward to take legal action. These claims are meant to provide justice and financial relief to families who have suffered a loss. The compensation sought often covers various damages, such as:
- Children of the deceased may be compensated for the loss of parental guidance, love, and support.
- Family members can recover damages for the loss of household contributions, including tasks such as cooking, cleaning, childcare, lawn care, and auto care.
- A spouse or domestic partner may seek compensation for the loss of companionship, care, moral support, and consortium.
- If the death occurred due to egregious negligence or an intentional act, punitive damages might be awarded. However, in California, punitive damages are only available if a survival action is filed.
