Fatal Motorcycle Accident in the Gustine Area

A man and his granddaughter succumbed to their injuries in a fatal motorcycle accident in the Gustine area on the afternoon of Sunday, February 7, 2021. The fatal crash occurred shortly after 1:30 p.m. at Gun Club Road and Hunt Road, the California Highway Patrol (CHP) reported.

A preliminary CHP traffic report revealed that a man was riding a motorcycle with a minor passenger northbound on Hunt Road. At the same time, a 2007 Acura TL driven by a 39-year-old woman was headed southbound on Hunt Road. For unknown reasons, the front left corner of the Acura struck the motorcycle, ejecting both riders off the bike.

The Acura came to a rest after striking a metal fence along the east shoulder. The Acura driver was hospitalized for major injuries at Mercy Hospital in Merced. The minor passenger of the motorcycle, a 7-year-old Gustine girl, was taken to Valley Children’s Hospital for treatment of serious injuries. Sadly, she succumbed to her injuries that night. The motorcycle rider and grandfather of the young child, 66-year-old Norman Figueroa of Gustine, was pronounced deceased at the scene. Further details on the incident were not immediately available.

What is Wrongful Death?

Wrongful death describes a fatal incident where negligent or reckless actions result in a loss of life. When this occurs, surviving family members may hold the at-fault party accountable for damages incurred. Those negligent parties may also be held liable for any losses the survivors have incurred. Financial compensation recovered through a wrongful death case may help with the cost of end-of-life medical expenses, funeral costs, lost income, loss of care, companionship, and protection, and more. Although wrongful death claims may seem challenging, an experienced Gustine personal injury lawyer is here to help.

Procedure for Filing a Wrongful Death Lawsuit in California

Bringing a wrongful death lawsuit against the at-fault party is not always straightforward. An investigation of the fatal accident is necessary to determine if negligence was involved. Once fault has been established, the evidence must be gathered and preserved to prove the wrongful death case. A claim must be filed with the insurance company representing the negligent party. If a fair settlement cannot be reached with the insurer, a lawsuit must be filed in court before the two-year statute of limitations to ensure the statute is protected in the case.
