A tragic incident along Interstate 5 in Natomas on November 16 resulted in a fatal motorcycle accident after the rider was ejected. Rear-End Collision Causes Motorcyclist to Be Thrown Into Another Lane
The collision caused the rider to be ejected from their motorcycle and ended up being thrown into the number two lane. He was reportedly struck by a number of vehicles, including a passing tractor-trailer. The motorcyclist, age 25 and a Rancho Cordova resident, died at the accident scene.
Investigation Being Carried Out Regarding Fatal Motorcycle Accident
The driver of the vehicle that struck him was hospitalized with injuries described as moderate after their vehicle went down an embankment on the freeway. No injuries occurred to the driver of the big rig, who remained at the scene and cooperated with the investigation into the fatal motorcycle accident. Preliminary findings by investigators at the scene of the fatal motorcycle accident reported that neither alcohol nor drugs were factors in the collision. At least three lanes along the interstate were closed down due to the investigation and to clear the scene.
Fault in a Rear-End Collision
In a fatal motorcycle accident or collision involving a driver striking another vehicle from the rear, the motorist in the back is usually found to be at fault. Most of these accidents involve distracted or drunk driving, tailgating, speeding, or other forms of negligence. With the help of an injury attorney, the family of the deceased loved one can file a wrongful death claim to recover damages.
Although a wrongful death lawsuit doesn’t alleviate their grief and suffering, it can help them avoid the financial stress a sudden death can bring and holds the at-fault party responsible. In this way, they can obtain some measure of justice and closure. Some of the areas in which compensation can be claimed include:
- The cost of the funeral and burial expenses is recoverable.
- The wages the deceased person would have earned until their retirement can be recovered, which includes pension and insurance benefits, bonuses, and additional perks of the job.
- The surviving spouse can claim loss of consortium, love and affection that was lost when the decedent died.
- Children and stepchildren who received at least half their support from the decedent, can claim loss of guidance and nurturing the loved one provided.
- In cases where the decedent survived for a time before passing away, the family has the option of filing a survival action, which also includes the medical expenses incurred before the death. An injury lawyer can explain what that entails.
- In cases where the death was caused by an egregious action or was intentional, the family may ask the jury to award punitive damages. Punitive damages are not compensation but are meant to punish the wrongdoer and dissuade that type of behavior in the future. This award is in addition to the wrongful death compensation.
